Ellie & Cat is an independent creator brand based in Chicago, Illinois, United States, run by its individual owner as an unincorporated business. The products and services on this site are sold by that owner, operating under the name Ellie & Cat.
These Terms of Service (“Terms”) are the agreement between you and Ellie & Cat (“we”, “us”, “our”). They apply to ellieandcat.show (the “Site”) and to the digital products and services we sell through it. By using the Site or buying from us, you agree to these Terms. If you don't agree, please don't use the Site.
What these Terms cover
These Terms cover:
- the Site itself and the content on it;
- digital products — downloadable files such as guides, handbooks, prompt packs, templates and checklists;
- services — written work we produce for you (for example a written prompt review) and cameo placements in our published content.
They do not cover:
- anything offered on third-party platforms such as Instagram, YouTube, TikTok or Facebook, including any subscriber or broadcast-channel features there — those are provided and billed by the platform under its own terms;
- the checkout itself, which is operated by our payment partner (see “Buying from us”).
Buying from us
One-time purchases
Everything sold through the Site is a one-time purchase. You pay once, you get the product or service you paid for, and nothing renews. Buying from the Site never creates a subscription, a trial, or a recurring charge. If we ever introduce a subscription or other recurring service, its price, billing period and how to cancel will be shown clearly before you subscribe — nothing in these Terms creates one.
Prices and taxes
Prices are shown in US dollars unless stated otherwise. Depending on where you are, sales tax or VAT may be added at checkout. Prices can change — for example, a founding price may end after launch — but the price you see at checkout is the price you pay.
Payment
Payments are processed by our payment partner, Paddle, which acts as the merchant of record for your purchase: it takes your payment, issues your receipt and handles applicable taxes. Its terms and privacy policy apply to the payment step, in addition to these Terms.
Your order
Your order is accepted when you receive an order confirmation or receipt. We may refuse or cancel an order — for example because of a pricing error or suspected fraud — and if we do, anything you have been charged will be refunded.
Delivery and access
Digital products are delivered electronically. After a successful payment you will receive a download link or access instructions at the email address you used at checkout — normally straight away. If nothing arrives, check your spam folder first, then email us and we will sort it out. Please keep your files safe; we may re-send a download on request within a reasonable period.
Services are delivered on the timeline shown on the product page (for example, “written report within 48 hours”). That timeline runs from the moment we have received everything we need from you, and it is a target, not a guarantee — if something will take longer, we will tell you.
Your licence to use digital products
When you buy a digital product we grant you a personal, non-exclusive, non-transferable licence to use it for your own creative and business projects — including videos you publish or sell. You may use the methods, templates and prompts in your own work.
You may not:
- resell, share, publish, upload or otherwise redistribute the files or any substantial part of them;
- use them to build a competing product or training material;
- remove any copyright or attribution notices;
- present the material as your own.
Ellie, Niko, the show's characters, artwork, episodes, name and logo remain ours. Buying a product gives you the method — it does not give you any right to use the characters or reference images themselves. If you break these rules we may end your licence.
Services and what you send us
For a service you will usually send us material — a prompt, a video, a photo of your cat and a line about them. You confirm you have the right to share it, and you give us permission to use it to deliver the service. Written reviews and reports reflect our professional opinion; how you act on them is up to you.
For a cameo, your cat's name and likeness will appear in a post we publish on our channels. By ordering a cameo you agree to that publication.
We can decline material that is unlawful, infringing, hateful, or otherwise unsuitable. If we decline your order for that reason, you get a full refund.
No guarantee of results
Our products teach a method that has worked for our own show. We make no guarantee of AI output, views, followers, revenue or business results. AI tools change, their output varies, and your results depend on many things outside our control. The performance figures on the Site are our own account's and are not typical or promised results for anyone else.
Third-party tools, links and referral codes
Our products are written for third-party AI tools (currently Seedance, run inside Runway). We don't control those tools; their availability, pricing and terms are theirs, and you need your own accounts to use them.
Some links on the Site are referral links, and the Site shows a referral code for Runway. If you sign up through one, we may receive credits or a commission from that company at no extra cost to you. We only refer tools we actually use.
Intellectual property
The Site and everything on it — text, artwork, characters, video, design, code — belongs to us or our licensors and is protected by copyright and other laws. You may view the Site for your own use. You may not copy, scrape, reproduce or republish it, in whole or in part, without our written permission.
Acceptable use
When using the Site or our services, you agree not to:
- break any applicable law or infringe anyone's rights;
- interfere with the Site's operation, security or other people's use of it;
- use automated tools to copy the Site or our products;
- send us material you don't have the right to share.
Refunds
Our Refund Policy explains when you can get your money back and how to ask. In short: digital products can be refunded in full within 14 days if you haven't downloaded them, and written services are non-refundable once the work has been delivered. Nothing in these Terms limits the statutory rights you have as a consumer.
Disclaimers and limitation of liability
To the extent the law allows, the Site and our products are provided “as is” and we don't promise they will be error-free or uninterrupted, or that they will suit a particular purpose.
To the extent the law allows, we are not liable for indirect or consequential losses — such as lost profits, lost revenue, lost data or wasted spend on third-party tools — and our total liability to you for any purchase is limited to the amount you paid us for that product or service.
Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, for fraud, or your statutory rights as a consumer.
Changes to these Terms
We may update these Terms from time to time. The current version is always on this page, with its “last updated” date at the top. A purchase is governed by the version in force when you made it.
Governing law and disputes
These Terms are governed by the laws of the State of Illinois and the federal laws of the United States, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of any mandatory consumer laws in the country or state where you live, and this section does not take those away.
If something goes wrong, please email us first — most problems can be sorted out quickly and informally. Where the law permits, any dispute that cannot be resolved that way will be brought in the state or federal courts located in Illinois, and you agree to the jurisdiction of those courts.
